Rezonate Wellness Centre Limited Practitioner Room Hire Agreement

  • ABOUT 

Rezonate Wellness Centre Limited (“we”, or “our”, or “us”) operating from Rezonate Wellness Centre, 16/17 Lindale Village, Lindale Drive, Paraparaumu, 5036 (“RWCL”, or “The Centre”) house treatment rooms (“A Room”, or “The Room”) and a workshop/classroom (“The Classroom”) which are available for hire.

Our Model

The Centre is a collaborative and cooperative space for client focused practitioners (“A Practitioner”, or “The Practitioner”, or “you”, or “yourself”) who offers an integrated and proactive approach to wellness. Combining western and eastern medicine services, treatments, programs, classes and support with personalized programs tailored to the clients wants and needs (A Treatment)

Our Mission is to put the WE into Wellness by working together for the greater good of the client. The practitioner needs to ensure that the client receives the best possible treatment and care based on their wants and needs, which may not be the service they offer.  By collaborating as one entity we can better serve the client. 

Our Intention is to help clients discover peace of mind, life purpose, make beautiful connections while improving their inner and outer health and wellbeing. 

  • TERMS OF AGREEMENT
    1. This Practitioner Room Hire Agreement (“Terms”, or “Agreement”) applies to A Practitioner who agrees with our business model, our mission and intention and to be bound by this Agreement, RWCL Privacy Policy and relevant legislation.
    2. The Practitioner agrees: to take due care of the building, fixtures, and fittings.
    3. The Practitioner agrees: that when vacating The Room it is left in the condition by which it was found.  If The Room is found in an untidy state The Practitioner is to inform RWC immediately. A penalty may be applied to The Practitioner who leaves The Room or The Centre in an unsatisfactory state.
    4. RWCL reserve the right to charge a bond. Where a bond has been paid, RWCL reserve the right to retain all or part of that bond where any damage has been caused by lack of care. RWC also reserve the right to seek reimbursement for such damage.
    5. When A Practitioner is vacating The Room at the end of their session, and another practitioner is entering, there is to be a respectful crossover period between outgoing and incoming Practitioners.
    6. All Practitioners hiring RWCL facilities are responsible for knowing and following all rules and relevant legislation.

This Agreement is in effect from 3rd May 2021

  • TREATMENT ROOMS
    1. There are four (4) treatment rooms available to hire at The Centre for Practitioners offering A Treatment that embraces our model, mission and intention.
    2. The hours of room hire are between 7:30am and 10:00pm Monday to Sunday.  Hire of The Room includes use of the kitchen/break out area and toilets.
    3. Client appointments hours are between 8am and 9:30pm.   
    4. Treatment rooms are available seven days per week, Morning, Afternoon and Evening, except Christmas Day, Boxing Day and Easter Sunday.
    5. The practitioners are responsible for their own room set up and take down.
    6. A cupboard is available to store personal equipment.
    7. The Room can be hired per time block with a minimum of a single time block over a regular time period.
    8. The block booking time periods are as stated below, part of each time block is to be considered as the whole time block, unless agreed otherwise.

Morning: 7:30am – 12:00pm (4.5 hours)

Afternoon: 12:30pm – 5:00pm (4.5 hours)

Evening: 5:30pm – 10:00pm (4.5 hours)

Combined 7:30am – 5:00pm (9 hours)

12:30pm – 10:00pm (9 hours)

All Day: 7:30am – 10:00pm (13.5 Hours)

  • CHANGES
    1. We reserve the right to change these Terms at any time and, unless stated otherwise, the changes take effect immediately. 
    2. A notice of the new Terms will be placed on the Website and sent out to all current practitioners. You are responsible for ensuring that you are familiar with the latest changes, and by continuing to hire The Room you agree to be bound by the revised Agreement.

  • CONDITIONS OF HIRE
    1. All client appointments for all practitioner’s must go through the online booking system on our Website.
    2. A room must not be sub-let.
    3. A Practitioner must not privately treat any RWC clients outside of The Centre, except when working with RWC at a collaborate venture.  Any practitioner found to be treating RWC clients privately outside of RWC premises will be in breach of this Agreement.  They will be asked to leave RWC and pay a penalty (to be determined) based on the treatment and number of instances.
    4. Room hire is for permitted use only.
    5. Permitted use includes, but is not limited to, western and eastern medicine services, treatments, programs, classes, and support, including designing personalized programs tailored to the clients wants and needs.
    6. Non-Permitted use includes, but is not limited to; illicit, illegal, unlawful, or lewd acts, for example, no drugs, drinking or sexual activities.
    7. Smoking is banned within or near The Centre.
    8. Alcohol is banned within or near The Centre. 
    9. You must: be respectful of all others within The Centre, to include all other practitioners, clients, guests and nearby tenants of Lindale Village and their property. 
    10. Noise must be kept to the minimum expected for the service being undertaken.
    11. You are responsible: for ensuring that yourself and none of your or guests or clients, cause any damage to The Centre or RWCL property.
    12. In the event of any damage to The Centre or The Centre’s equipment that occurs as a direct result your actions, your guests or clients; you agree to make good at your own cost.
    13. You agree to indemnify RWC for any damage or loss to any property brought into The Centre by yourself, your guests or your clients. 
    14. You acknowledge that RWC does not carry any insurance that protects you in any claim for accident, injury or damage arising out of your action or negligence or by your guests or clients’ negligence or action. It is strongly recommended that you obtain your own Public Liability insurance in relation to any damage that may be caused to RWCL property. 
    15. You are responsible for the maintenance of good order throughout the time of hire and keeping your area clean, tidy and hazard free.
    16. No fixtures are to be applied to any walls without the prior written consent of RWCL, this includes, but is not limited to, any adhesives, such as glue, blu-tack, cellotape, pins etc.
    17. You must: clean up after yourself at the end of your hire session or last appointment, whichever is later.  This may mean: –
  1. tidying up equipment,
  2. sweeping or vacuum the floor,
  3. emptying the bin,
  4. changing the linen,
  5. keeping the kitchen tidy,
  6. and any other task that is needed to ensure the area is clean and tidy for the next Practitioner to come in.

  • INCLUSIVE HIRE COSTS
  1. Running costs, such as lease, electricity, and maintenance.
  2. Respectful use of Kitchen facilities and break out area.
  3. Security alarm/monitoring.
  4. Internet/WiFi.
  5. Appointment booking system

  • SECURITY

When vacating The Room a practitioner must: –

  1. Check that: all heaters or fans are turned off. 
  2. Check that: all lights are turned off.
  3. Check that: all windows are closed.
  4. Check that: all doors are securely locked.
  5. The premises must be fully vacated by 10:00pm.  The security alarm is automatically set to come on and any fee charged as a result of an unwarranted callout will be charged back to The Practitioner.
  6. Where the Practitioner has been entrusted with a key to The Centre, they must ensure that the key is kept safe at all times with no distinguishing marks of what the key belongs to.  
  7. No duplication of any key is permitted. 
  8. Lost Key: where A Practitioner has lost the key, a $40 fee will be charged for issuing a new key.
  9. A log of all keys issued is kept by RWCL and updated on a regular basis.
  10. When the Room is no longer required by A Practitioner the key must be returned to RWCL.

  • PRACTITIONERS

Practitioner Definition: An individual, company or sole trader that hires a treatment room from Rezonate Wellness Centre Limited on (a) set day(s) and time(s) on a regular basis, for the purpose of providing A Treatment.

  1. RWCL reserve the right to request a police check on any Practitioner. 
  2. All practitioners are considered to be self-employed or an employee of another organisation. None are considered to be employees of Rezonate Wellness Centre Limited in any way. 
  3. All practitioners are solely responsible for their own legal, tax and insurance obligations and do not receive any employee benefits from RWCL such as holiday or sick pay. 
  4. It is strongly recommended that all practitioners hold their own Indemnity insurance in relation to any damage caused to third party property. 

  • HIRE TERMS
    1. A treatment room can be hired for a fixed $ amount per block of time (“Fixed”) or as a % of the $ cost of an individual treatment (“Commission”).  
    2. One off, per hour room hire is by exceptional circumstances only.
    3. The Fixed room hire fee is payable a week in advance, and regardless of if the practitioner has clients or not.
    4. The Commission room hire fee is payable only when a client receives A Treatment from The Practitioner.
    5. Where a Practitioner pays Fixed room hire, the minimum hire term is to be 1 month.
    6. Where A Practitioner pays Commission room hire, the minimum hire term is to be 6 months.
    7. Treatment Rooms are available on a shared basis. Should A Practitioner need the room on a full time, seven days a week, 7:30am to 10pm basis, they must ensure that they are available for clients on all days and times the room booked, and not as a means to stop other Practitioners from using the Room. 
    8. Where A Practitioner wants to leave RWC, there is to be a minimum notice period of 2 weeks.

  • ROOM HIRE PAYMENTS

Fixed Room Hire

  • Fixed room hire practitioners will pay one week in advance, upon receipt of an invoice from RWCL.
  • Payment to RWCL is to be by automated direct credit into RWCL bank account. Cash is not accepted as a form of payment.
  • Non-payment of invoice could result in suspension of room hire.

Commission Room Hire

  • Commission room hire practitioners pay room hire by deduction of an agreed % of the appointment charge out rate where the client pays the full rate of the appointment to RWCL by Eftpos.
  1. The practitioner must generate an invoice for RWCL to pay against. 
  2. RWCL will make the payment to the practitioners designed bank account, after reconciliation and within 7 days of receipt of invoice.

  • ACCEPTING CLIENT PAYMENTS

Fixed Room Hire

  • A Fixed room hire practitioner can: accept their own payments from clients in return for the treatment provided.  
  • In the event that the client has paid in advance online, this will be refunded to the Fixed room hire practitioner upon conclusion of The Treatment. RWCL may make charge a fee of up to 2.5% for online client payments.
  • Fixed room hire practitioners may have the option to use RWCL Eftpos facilities, for a nominal fee. The Practitioner will be allocated a code where the clients payment will go directly into the Practitioners own designated bank account. Where a client pays by credit card, an additional fee of 2.5% will be charged.

Commission Room Hire

  1. The commission room hire must: accept client payments via RWCL Eftpos facility only unless payment has been made online.
  2. The commission room hire must not: accept cash.

  • EXISTING CLIENT BASE

Where the practitioner has an existing client base, this client base will remain the property of the practitioner.  

As an example only: should the practitioner have an existing client base of 200 clients when they begin working from The Centre. Any of those clients that makes a booking with A Practitioner at The Centre, must book through the RWC online booking system.  This allow us to adhere to our Mission and Intention of being client centric and putting the WE into Wellness.

Should the practitioner leave The Centre, The Practitioner may take the details of their 200 clients with them, but unless requested by the client, the client record will remain with RWCL. 

The Practitioner must not treat RWCL clients at their home or other premises, see clause 5.4

  • WORKSHOP/CLASSROOM 

The Classroom hire rates are on casual or regular hire basis.  

The Practitioner may receive a set number of regular hire booking rates for events they personally hold while they work from The Centre. There is no further discount on classroom rates. Should the Practitioner leave the centre and wish to book the Classroom Room, the rates will be charged as per an external user.

The Classroom may be used for workshops, classes, talks, day retreats or similar events, covering almost any topic, with the exclusion of non-permitted activities:  See Classroom Room Terms & Conditions for full details. 

The following times are available to hire as a block booking: –

Morning: 7:30am – 12:00pm

Afternoon: 12:30pm – 5:00pm

Evening: 5:30pm – 10:00pm

Combined 7:30am – 5:00pm 

12:30pm – 10:00pm

All Day: 7:30am – 10:00pm

  • HEALTH AND SAFETY
    1. The Practitioner must: adhere to all Health & Safety rules and regulations.
    2. The Practitioner must: make their guests and clients aware of emergency exits and evacuation procedures.
    3. The Practitioner is responsible: for keeping The Centre hazard free.
    4. Any incident, hazard, injury, or event is to be reported to RWC within 24 hours.  
    5. The Practitioner must: record any incidents, hazards, injuries, or events that occur while working at The Centre.
    6. In the event of an emergency, the practitioner is to call 111 and inform RWCL within 24 hours.
    7. All exit doors must be kept free from obstruction,
